Terms of Sales

Article 1 : Items

The items presented on this site are my whole property.
I do not propose reproductions, all items are authentic antiques, they are sometimes in perfect state of conservation, restored or in the state.
I make a commitment to inform systematically the state or the possible damages due to the wear of time or of its used. The responsibility of the company Mr Sergio would not know how to be engaged in case of non compliance with the legislation of the country or products are delivered. It is up to the buyer to verify with the local authorities the possibilities of import or use of products or services which it intends to order.

Article 2 : Prices

You are on a showroom, for a concern of incontrollable competition, the prices are informed after a contact by the form envisaged for this purpose.
Any customs charges, import duties, local taxes, federal taxes are chargeable to the buyer. These sums raise from the whole responsibility of the buyer both in term of statement and from payment in and / or competent bodies of the concerned country.

Article 3 : Order

The order is definitive during the confirmation of the Company Mr Sergio after acceptation of the buyer.
The address of destination must be confirmed by the buyer. No responsibility will be taken into account in case of error of the buyer.
The Mr Sergio company is not responsible for uninsured goods.
If the insurance is not contracted by the buyer in the confirmation of order all the risks inherent to the transport are incurred by the buyer.
If the insurance is contracted by the buyer in the confirmation of order the buyer verify the state of the goods before signing the delivery note. If the goods are damaged or missing of in the transport, the buyer has to refuse the parcel.

Article 4 : Payment

4 kind of payment s are proposed by the Company Mr Sergio :

• Bank transfer on the bank account of the Company Mr Sergio in euro only.
• Bank card through the secure site of PAYPAL, see the modalities on sites www.paypal.fr and www.paypal.com.
  Expenses relative are offered for any exceeding orders 1000 USD.
• Post money order at the address of the company Mr Sergio
• Bank check in euro only or payable in a French bank.

In any case the item will be reserved during the time of the deal and declared sold when the account of the company Mr Sergio will be credited.

Article 5 : Delivery

From reception of the payment on the bank account of The company Mr Sergio, the order is accepted and the operations of deliveries start.
The packaging and the delivery is made within 5 working days after confirmation of the address of the buyer.
The Company makes a commitment to operate everything to respect the aforementioned deadline.
Consequently the buyer makes a commitment not to prevail of a cancellation, a reduction of price, refusal of the goods or to ask for damages or for penalties of which that nature whether it is.
The company Mr Sergio will not be considered responsible for the impossibility to deliver the product in case of error in the title of the address and phone number of the buyer.
The company Mr Sergio will not either be responsible for deadlines not respected by the company of chosen delivery.

Article 6 : Retraction and disputes

In application of the provisions of the article L121-20-12 of the code of the consumption, the buyer in the possibility of returning the product ordered within 14 days as from day of opening.
Crossed this deadline the article L121-20-12 is not applicable.
The expenses of return are always chargeable to the buyer, the parcel must have returned to the address indicated on the site.
So that the refund is accepted one or several objects have to be in exact sound state of origin during the sending, in the accompanied original packing of the original invoice.
The Mr Sergio company makes a commitment to pay off the customer at the latest 30 days following the reception of the forwarded object.
All the relations between the Company Mr Sergio and his customers are governed by the French law.
In case of difficulty in the application of the present general Conditions of sales, the Mr Sergio company invites the buyers to look for an amicable solution by getting in touch with the company Mr Sergio.
In case of failure of the negotiations, the following measures apply, the present contract being subjected to the French legislation, the commercial court of the head office of the Company Mr Sergio will be only competent to treat any disputes resulting from the application of the present General Conditions of Sales.
